Establishing the descent from the mother – a prerequisite for establishing the descent of a child

Abstract

The paramount interest of the child is in the basis of resolving all the issues in connection to the descent. There are some differences and certain limitations both in establishing and challenging the descent from the mother and the father. It should also be pointed out that the methods for establishing maternity and paternity are divided into general and specific. But the establishment of the descent from the mother most often determines also the establishment of the descent from the father, and, therefore – determines in general the descent of the child from both parents.
